In this paper, I will depict the manner by which a basic functionalist approach is understood in the region of wellbeing advancement programs on smoke free conditions. It currently realized that taking in others' tobacco smoke, known as inactive smoking, marginally expands the danger of lung ailment and malignancy, in spite of the fact that the hazard is still significantly less than if you smoke yourself. In spite of the fact that funnel and stogie smokers have a lower danger of lung malignant growth than cigarette smokers they are at an a lot more serious hazard than non-smokers. In certain families, smokers might be bound to create lung malignant growth because of a flawe d quality. Lung disease is the uncontrolled development of irregular cells in the lung. Typical lung tissue is comprised of cells that make lungs. Now and then the cells mess up are influenced by the tar in cigarettes and that cell repeat fiercely, without takeing the right shape and capacity of a lung. That propagation can shape tumors that obstruct the lung and make it quit working as it should. Due to the enormous size of the lungs, malignancy may develop for a long time secretly. Obviously, the wellbeing dangers joined to smoking hugely exceed the delight that individuals get from smoking. Likewise, smoking is an over the top expensive propensity to have. On second thought, smokers are spending their cash on something that is a hazard to their wellbeing. If they quit any pretense of smoking, they could spare a generous measure of cash and lessen the conceivable outcomes of having medical issues. What's more, smoking likewise influences non-smokers. It is realized that non-smokers who are presented to tobacco become detached smokers who are additionally influenced by this propensity. Hence, smokers are imperiling themselves by smoking as well as taking a chance with the lives of others. When in doubt, smokers ought to think about that the opportunity of each individual finishes where the opportunity of the another beginnings. The Effects Of Fresh Garlic Extract On Acetaminophen Essays

The Effects Of Fresh Garlic Extract On Acetaminophen Essays The Effects Of Fresh Garlic Extract On Acetaminophen Essay The Effects Of Fresh Garlic Extract On Acetaminophen Essay Presentation Oxidative accentuation and lipid peroxidation play cardinal capacities in the pathogenesis and designed development of a few surprises. Malignant growth, maturing, coronary vein infection, and incendiary techniques have all been connected to the coevals of responsive O species and harmful metabolites of lipid peroxidation responses. 1, 2, 3 In numerous hypothetical records, exhaustion of liver glutathione shops and other cell reinforcement particles comprise an of import instrument for the inception of oxidative accentuation and the chaperon mischief to natural atoms, for example, proteins and nucleic acids, and the enactment of nuclear composed content factors that might be of import in the coevals of proinflammatory cytokines. A few enemies of oxidants have been utilized in the intercession of oxidative pressure interceded infections, including nutrients ( C and E ) , carotenoids, and minerals, for example, Se. 9, 10, 11,12 Besides, ethnomedical designs have depended on the use of works stocks which are currently known to consolidate cell reinforcement optional metabolites.13 Garlic and garlic stocks have been utilized in clinical example since relic. Arranged pharmacological surveies have other than covered the advantages of its imbuements and stocks on basic physiological maps including their cancer prevention agent, 14 cardioprotective, 15 hepatoprotective, 16 anticancer 17 and mitigating impacts. 18 However, the greater part of these surveies concentrated on the use of matured garlic mixture ( AGE ) or other business stocks. Here we report on the counter oxidant and hostile to lipid peroxidative belongingss of new ethanolic imbuement of neighborhood Ugandan cultivars of Allium sativum in mice hypotheti cal records of Datril actuated lipid peroxidation and oxidative accentuation. We conjecture that customary ingestion of new Allium sativum could hinder oxidative accentuation and ensure against sicknesses related with oxidative accentuation and lipid peroxidation responses. MATERIALS AND METHODS 1. Assortment, Identification, and Processing of Garlic Bulbs. Bulbs of a nearby grouping of garlic ( Allium sativum L. ) were acquired from Ishaka Town in Western Uganda, and distinguished by a certified taxonomer. Cold extraction of the Allium sativum was done at room temperature ( 18-22 O C ) as follows: Fresh Allium sativum bulbs were land to an okay glue using a mechanical plane and 50 g of the glue was placed in a 250 milliliter conelike carafe and secured with 100 milliliters of 80 % ethyl liquor, stoppered with cotton fleece, and permitted to remain in obscurity at room temperature for 48 hours. The ethanolic imbuement was sifted off with a Whatman no. paper into pre-weighed vanishing dishes, while the buildup in the jar was washed with a more remote 100 milliliter of 80 % ethyl liquor and added to the imbuements in the dissipating dishes. The filtrates were so vanished to a sweet buildup using a turning extractor at 40 O C. The dishes were so weighed again on a ternary bar balance and the per centum yield was determined as follows: Weight of concentrate = weight of disintegrating dish after vaporization weight of dish before add-on of mixture ; Rate yield = whole weight of concentrate ? weight of glue utilized ( 50 g ) A-100. The mixtures were pooled together into an impermeable holder and put away refrigerated ( at - 4 oC ) until required for utilization. For use, a piece of the implantation was gauged and disintegrated in ordinary saline arrangement. New readyings were made on every twenty-four hours of the examination. The subsequent arrangements were infused intraperitonially into the mice. 2. Lab Animals Swiss mice 6-8 hebdomads old gauging 18-32 g were acquired from the Pharmacology Department of the Mbarara University of Science and Technology in Uganda. They were kept up and habituated in plastic coops in the lustful place of the School of Health Sciences, Kampala International University, Western Campus for one hebdomad, thus after utilized for the surveies. The mice had free dish to H2O and were taken care of standard gnawer pellets ( bought from a neighborhood business supplier ) not indispensable. Compulsion conditions were 12 hour dim/light rhythms, and mean natural temperature of 20 o C. 3. Intense Toxicity Test and Determination of LD50 The LD50 of the imbuement was resolved in the mice by the procedure depicted by Bernas et Al. ( 2004 ) .19 The confirmation interim of the LD50 was assessed by the Litchfield Wilcoxon technique using a figuring machine software.20 4. Test Design Thirty Swiss mice of both genders were utilized for the test overview. The vivify creatures were assembled unpredictably into 6 gatherings of 5 each and directed with the medications/removes as follows: Group I got physiological saline i.p. simply ; bunch II got acetaminophen 250 mg/kg i.p. singular dose only ; bunch III was given garlic implantation 250 mg/kg for 5 yearss before an individual i.p. dose of acetaminophen 250 mg/kg ; bunch IV got 500 mg/kg garlic implantation for 5 yearss before 250 mg/kg Datril ; bunch V were given 750 mg/kg garlic mixture for 5 yearss before 250 mg/kg Datril ; bunch VI got 25 mg/kg silymarin for 5 yearss before an individual i.p measurements of acetaminophen 250 mg/kg. The implantation was regulated as an individual one time everyday measurements, while Datril was directed following 12 hours quick. 5. Test Collection The mice were yielded under core sedation, and their livers were acquired from the mice washed with super cold typical saline, trailed by 0.15 M Tris-support ( pH 7.4 ) , blotched and gauged. The liver was so homogenized in 0.15 M Tris cradle to a convergence of 10 g for every 100ml of homogenate and utilized for TBARS, glutathione, catalase, and SOD checks. 6. Biochemical Assays Thiobarbituric corrosive receptive substances ( TBARS ) in the liver homogenates were evaluated by the technique for Ohkawa et al 21 as a stage of lipid peroxidation responses. Catalase exercises in the homogenates were assessed by the strategy for Johansson and Borg, 22 ( which relied upon the response between methyl liquor and catalase within the sight of H peroxide ) with packs acquired from Calbiochem USA. Superoxide dismutase check was evaluated by the strategy for Kakkar et Al, 23 using units acquired from Calbiochem. The NWLSS GSH spectrophotometric measure unit was utilized for the evaluation of glutathione in the homogenates ( Northwest Life Sciences Specialties LLC, USA ) . In this technique, 5-5 dithiobis ( 2-Nitrobenzoic corrosive ) DTNB, responds with glutathione to compose 5-thionitrobenzoic corrosive ( TNB ) which has ideal absorbing at a frequency of 412 nanometers. The creator s convention was absolutely followed. 7. Figures Analysis Figures were introduced as normal Aâ ± basis slip-up of the mean. Measurable investigation was by the one way examination of disparity ( ANOVA ) using the SPSS adaptation 10 bundle, and a P esteem lt ; 0.05 was viewed as significant. Outcome Organization of harmful dosages of Datril delivered articulated consumption of the liver glutathione shops and the cell reinforcement chemicals, superoxide dismutase, and catalase, and significant lift of lipid peroxidation stocks assessed as thiobarbituric corrosive receptive substances ( TBARS ) . Liver glutathione degree in bunch II was fundamentally lower than in the negative control ( p lt ; 0.005 ) as are SOD ( P lt ; 0.001 ) and catalase ( p lt ; 0.05 ) . The liver TBARS degree in bunch II was fundamentally higher than in bunch I ( P lt ; 0.005 ) . The removal of new Allium sativa imbuement and silymarin secured against these changes in a portion subordinate mode and carried the qualities to degrees tantamount to those of the negative controls ( P gt ; 0.01 ) as appeared in table 1 and in figure 1. Introduction The interview process is the gateway to basically fill a position from a company. The function of an interview is to assess candidate’s skills to pertinent questions that are necessary to fill in the needs of an organization. Fact of the matter is, structuring an effective and efficient interview process is not really basic, for it entails ethical, legal and moral considerations with each question asked. Since we would cover up ten questions in this elective, the two criteria’s that I am going to include as a ranking score would be a confidence rating scale in which to scale the level of confidence the way each candidate answers the question and a question satisfaction rating scale in which for each person that conducts the interview will also rank the level of satisfaction on each question that had been answered by the interviewee (Pulakos, 1997). Both scales would be scaled from 1 to 5 in which 1 would be the lowest attainable score and 5 would be the hig hest. This then would make up a perfect score of 100 points as confidence would make up a total perfect score of 50 points for ten the questions and also the same with satisfaction. Organized Racism Essay Example For Students

Organized Racism Essay Most people only know of one or two racist organizations but there are many, many more. Although we rarely see it in real life, racism lurks all around us. The most famous organization and normally the only one known of are the Ku Klux Klan or KKK. However there are many more racist organizations and religions many anti-racism organizations. Many people are racist without even realizing it. Racism organizations are everywhere, and more will keep on growing until someone is able to stop it. The most commonly known racist organization is the KKK or Ku Klux Klan. The Ku Klux Klan has extreme hatred to all Jewish, Negro, and Asian people. They believe that the pure White Christian people should rise above all other people. The Ku Klux Klan promotes protectionism in foreign trade, closing the southern border, and laws prohibiting foreigners from purchasing American property and industry. History proves that the Ku Klux Klan is Americas oldest and most effective White Christian Fraternal organizations. The Klan believes that it is doing successfully now because people are beginning to realize that equal rights for all people is just a myth, still people pretend that they believe in it. The Ku Klux Klan official web page address is www.kkk.com. Another racist organization is the Posse Comitatus. The Posse Comitatus is an intermittently active, loosely organized group of Christian identity activists dedicated to survivalism, vigilantism, and anti-government agitation. Following the pseudo-religious tenets of the Identity movement, Posse members typically proclaim Jews to be the synagogue of Satan, blacks and other people of colour to be subhuman mud-races and Northern European whites to be the Chosen People of Biblical prophecy. The name of the group Posse Comitatus translates from Latin to mean power of the county, and the Posse believes that all governmental power is rooted at the county, not Federal, level. Posse Comitatus is the term Gordon Wendall Kahl, a North Dakota farmer, gave to his far-right militia organization of local farmers and ranchers. He founded the organization in the early 1970s to fight the federal and state encroachment into their local affairs. The posse has attracted many Klan members and other anti- Semites. The Nation of Islam is an anti-white and anti-Semitic religion based on the teaching that whites are devils created in an evil scientists experiment. The Nation of Islam identifies itself as Islamic. Members call god Allah and call themselves Muslims, they teach and worship in mosques, and they appeal to the prophet Muhammad. The chief leaders of the Nation of Islam are Elijah Muhammad, Malcolm X, and Minister Farrakhan. They believe that the devil is the white man, the Caucasian race. They think that the black race is trillions of years old and the white race is only six thousand years old. The Nation of Islam thinks that the white race is not equal to the black race because the God of Righteousness created the black race and Yakub created the white race. They believe Yakub was an original black man who was the father of the devil. As the father of the devil he created the white race, the race of devils, which are enemies to the black race. Therefore the white race is not made by nature to accept righteousness.World Church of the Creator is a white supremacist organization that preaches a theology called Creativity. That religion was established for the survival, expansion, and advancement of the white race exclusively. Their reason for white supremacy is that they figure that since the white race is responsible for all of earths advancements throughout history, it should be the only race that should expand and advance. They feel that the white race is facing a huge threat because only 1 in every 12 people on the earth is white. The ratio has dropped tremendously and they feel that it will only get worse. They think that it is disgusting that white people are marrying people of other races and are only harming their fellow race. .ub0d5e6c98fe00636998e47e630d58479 , .ub0d5e6c98fe00636998e47e630d58479 .postImageUrl , .ub0d5e6c98fe00636998e47e630d58479 .centered-text-area { min-height: 80px; position: relative; } .ub0d5e6c98fe00636998e47e630d58479 , .ub0d5e6c98fe00636998e47e630d58479:hover , .ub0d5e6c98fe00636998e47e630d58479:visited , .ub0d5e6c98fe00636998e47e630d58479:active { border:0!important; } .ub0d5e6c98fe00636998e47e630d58479 .clearfix:after { content: ""; display: table; clear: both; } .ub0d5e6c98fe00636998e47e630d58479 { display: block; transition: background-color 250ms; webkit-transition: background-color 250ms; width: 100%; opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #95A5A6; } .ub0d5e6c98fe00636998e47e630d58479:active , .ub0d5e6c98fe00636998e47e630d58479:hover { opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #2C3E50; } .ub0d5e6c98fe00636998e47e630d58479 .centered-text-area { width: 100%; position: relative ; } .ub0d5e6c98fe00636998e47e630d58479 .ctaText { border-bottom: 0 solid #fff; color: #2980B9; font-size: 16px; font-weight: bold; margin: 0; padding: 0; text-decoration: underline; } .ub0d5e6c98fe00636998e47e630d58479 .postTitle { color: #FFFFFF; font-size: 16px; font-weight: 600; margin: 0; padding: 0; width: 100%; } .ub0d5e6c98fe00636998e47e630d58479 .ctaButton { background-color: #7F8C8D!important; color: #2980B9; border: none; border-radius: 3px; box-shadow: none; font-size: 14px; font-weight: bold; line-height: 26px; moz-border-radius: 3px; text-align: center; text-decoration: none; text-shadow: none; width: 80px; min-height: 80px; background: url(https://artscolumbia.org/wp-content/plugins/intelly-related-posts/assets/images/simple-arrow.png)no-repeat; position: absolute; right: 0; top: 0; } .ub0d5e6c98fe00636998e47e630d58479:hover .ctaButton { background-color: #34495E!important; } .ub0d5e6c98fe00636998e47e630d58479 .centered-text { display: table; height: 80px; padding-left : 18px; top: 0; } .ub0d5e6c98fe00636998e47e630d58479 .ub0d5e6c98fe00636998e47e630d58479-content { display: table-cell; margin: 0; padding: 0; padding-right: 108px; position: relative; vertical-align: middle; width: 100%; } .ub0d5e6c98fe00636998e47e630d58479:after { content: ""; display: block; clear: both; } READ: 4th grade Living Things Unit 4, Lesson 1The National Alliance is a Neo-Nazi organization based in West Virginia. Like Any Hall Of Fame, Its Inductees Are The Best In Whatever They Do,

Like any hall of fame, its inductees are the best in whatever they do, from baseball or football to something like being President. If you are a member of any hall of fame (including the one for the Presidents), it means that you have done something special or have a certain quality about yourself that makes you worthy to be in a hall of fame. My nominee for the Presidents hall of Fame is our seventh President of the United States, Andrew Jackson. I'll go over his presidency, focusing on both the highs and the lows of his two terms in office, from 1829-1837. The issues that I'll focus on are states' rights, nullification, the tariff, the spoils system, Indian removal and banking policies; these controversies brought forth strong rivalry over his years of president. He was known for his iron will and fiery personality, and strong use of the powers of his office that made his years of presidency to be known as the "Age of Jackson." Andrew Jackson was born on March 15, 1767, in a settle ment on the border of North and South Carolina. He was orphaned at age 14. After studying law and becoming a member of the Bar in North Carolina later he moved to Nashville Tennessee. Their he became a member of a powerful political faction led by William Blount. He was married in 1791 to Rachel Donelson Robards, and later remarried to him due to a legal mistake in her prior divorce in 1794. Jackson served as delegate to Tenn. in the 1796 Constitutional convention and a congressman for a year (from 1796-97). He was elected senator in 1797, but financial problems forced him to resign and return to Tennessee in less than a year. Later he served as a Tennessee superior court judge for six years starting in 1798. In 1804 he retired from the bench and moved to Nashville and devoted time to business ventures and his plantation. At this time his political career looked over. In 1814 Jackson was a Major General in the Tennessee Militia, here he was ordered to march against the Creek Indians (who were pro-British in the war of 1812). His goal was achieved at Horseshoe Bend in March of 1814. Eventually he forced All Indians from the area. His victory's impressed some people in Washington and Jackson was put in command of the defense of New Orleans. This show of American strength made Americans feel proud after a war filled with military defeats. Jackson was given the nickname "Old Hickory", and was treated as a national hero. In 1817 he was ordered against the Seminole Indians. He pushed them back into Spanish Florida and executed two British subjects. Jackson instead that his actions were with approval of the Monroe administration. His actions helped to acquire the Florida territory, and he became a provisional governor of Florida that same year. In 1822 the Tennessee Legislature nominated him for president and the following year he was elected the U.S. senate. He also nearly won the presidential campaign of 1824 however as a result of the "corrupt bargain" with Henry Clay. Over the next four years the current administration built a strong political machine with nationalistic policies and a lack of concern of states rights. In 1828 through a campaign filled with mud slinging on both sides, Andrew Jackson became the seventh President to the United States. Instead of the normal cabinet made up by the president, he relied more on an informal group of newspaper writers and northern politicians who had worked for his election. I believe that this made him more in contact with the people of the United States, more in contact with the public opinion and feelings toward national issues President Jackson developed the system of "rotation in office." This was used to protect the American people from a development of a long-standing political group by removing long-term office holders. and symbolicall... Free Essays on Where The Wild Roses Grow ~ NickCave Free Essays on Where The Wild Roses Grow ~ NickCave â€Å"Where the Wild Roses Grow† by Nick Cave is a tragic tale of ill-fated love. Nick Cave uses a variety of literary elements such as foreshadowing, symbols and mood to strengthen and deepen the effect of his poem. The tale of Elisa Day’s first and her last love takes place over a period of three days. From the moment he walked in her door she was captured by his charm and trustworthy personality: â€Å"When he knocked on my door and entered the room/ My trembling subsided in his sure embrace/ He would be my first man.† The man appears to be drawn to her at first sight: â€Å"From the first day I saw her I knew she was the one/ As she stared into my eyes and smiled.† On the second day their feelings toward each other become more apparent. â€Å"On the second day I brought her a flower/She was more beautiful than any woman I’d seen.† The man notices Elisa’s exceptional beauty and seems to desire it, but it is still unclear what his intentions are. Elisa on the other hand sees the man with adoring eyes and wants to be with him and to be comforted by his tender embrace: â€Å"I nodded my head as I lay on the bed.† On the third and final day after E lisa accepts her love’s offer to take away all of her pain he takes her to where the wild roses grow. There on the banks where the wild roses grow the man murders Elisa merely muttering â€Å"All beauty must die.† Elisa is referred to as â€Å"the Wild Rose† throughout the poem, symbolizing that she is willful and not refined. The man often connects Elisa to a rose especially in beauty: â€Å"For her lips were the colour of the roses.† The final connection he makes is placing a rose between her teeth after killing her down by the river where the wild roses grow. At first the man is charming and seems very reliable and in love with Elisa: â€Å"Do you know where the wild roses grow/ So sweet and scarlet and free?† The use of the word scarlet deepens the meaning of his words and symbolicall...

Fashion analysis of louis vuitton Essay Example | Topics and Well Written Essays - 1250 words

Fashion analysis of louis vuitton - Essay Example The purpose of the paper "Fashion analysis of louis vuitton" is to analyse Louis Vuitton’s high fashion collections for Autumn Winter 2009 (AW09) and Spring Summer 2010 (SS10) and to investigate the supply chain and production processes of the company. Besides advertising through celebrity endorsement and sports sponsorship, Louis Vuitton’s success is attributed to the control it maintains over all its operations from creative design to distribution. This ensures not only a commitment to quality (New York Magazine 1985), but also its high operating margins of around 45 percent as compared to those of its closest competitors. Marc Jacobs is Louis Vuitton’s high profile designer. Summer 2010 (SS10) collections depicted designer Marc Jacobs’ blending of various influences. Olde world appeal was combined with â€Å"a little bit of French fancy, a sprinkling of 80s bad taste and a Playboy bunny† look . The fabrics used were mainly cashmere, wool, silk, s atin, lame velvet, fox fur, taffeta, embroidered panne velvet, re-embroidered printed fabrics, leather and diaphanous tulle. In Figure 1. above, the mixed influences are clearly visible, and the clothes range from the â€Å"sublimely wearable† to the â€Å"gorgeously unusual to the not so delightfully strange†. The collection is divided into groups based on different colours. The black apparel were most appealing, and the touches of colour at the sashes added to the beauty of the dresses. The oversized shoulders lent an unusual but attractive look.

Romeo and Juliet Coursework Example | Topics and Well Written Essays - 1000 words

Romeo and Juliet - Coursework Example Dramatic Devices in Shakespeare’s Romeo and Juliet Formal patterning is the meticulous arrangements of events, characters and scenes that help shape and form a play’s storyline. This is an important dramatic device because it allows the audience to discern and anticipate the flow of the story enough to gain interest and pay close attention to it. To achieve this in Romeo and Juliet, Shakespeare constructed parallel scenes where characters that are about to play important roles in the tragic end are constantly present and developed, helping build the momentum and anticipation of the tragic end. Formal patterning is also employed to build a close synergy between opposing ideas such as â€Å"comedy and tragedy, triviality and seriousness, laughter and tears, minuteness and vastness, youth and age, and of course, love and death.†2 The use of this device keeps the audience’s interest from straying away because of the conflicting nuances of the play. Dramatic ir ony, on the other hand, is another device that keeps the audience’s attention because it grants important knowledge to the former that is not shared by some of the important characters. The tension that this knowledge creates, especially when the characters’ lack of knowledge threatens the turn of events, necessarily gets the involvement of the audience, and hence, keeps it focused on the play. The employment of dramatic irony in Romeo and Juliet does not only happen in the course of the later scenes, but is strewn throughout the play in small doses so as not to detract its impact in the last act. Foreshadowing is another dramatic device and it means the employment of suggestive words or images that indicate to the audience what will happen next in the course of the play.3 The purpose of foreshadowing is to build suspense because it allows the audience to anticipate the next scenes, engage in guesswork and validate them by closely following the story. This motivates th em not to keep their attention off the play. Shakespeare employs this technique abundantly in Romeo and Juliet, largely through the chorus and the dialogues of various characters. The prologue, for example, speaks of a â€Å"pair of star-crossed lovers take their life† that hints to the audience a tragedy about to happen in the course of the play. Two Scenes as Concrete Examples: Formal Patterning In Act 1, Scene 1, the characters of Tybalt, Mercutio and Paris, among others, are introduced. Tybalt plays a pivotal role as his death serves as a catalyst in Capulet’s decision to marry off Juliet to Paris and Romeo’s banishment from Verona. He is introduced early on in Act 1, scene 1 as a vain, proud and aggressive cousin of Juliet. He is likewise made to appear in subsequent scenes where his aggressiveness and hatred for the Montagues become more and more evident. The early introduction of such characters as Tybalt, Mercutio and Paris, among others, and their recur ring presence in subsequent acts and scenes allow their respective

Business Law Essay Example for Free

Business Law Essay Introduction At the course of Business Law, we got the knowledge about the contract. In addition we have an assignment that provides a contract analysis. This evaluation of the contract will be reviewed in accordance with the following requirements: 1. What specifically makes this contract enforceable? 2. What are the responsibilities of both parties? 3. What are the possible damages and liabilities? 4. What impact does a potential breach of contract have on the business? 5. Summarize, by reflecting in general on the impact legal issues can have in both small and large businesses. So, a contract is any voluntary legally binding agreement between two or more people or businesses. In our case the two parties will be represented by The State of Oregon, and by Pro DX, who will provide services and goods to the first one. 1. What specifically makes this contract enforceable? Based on the English Statute of Frauds, not every contract has to be in writing to be valid and enforceable, but some contracts should be. This agreement between State of Oregon and Pro DX, should be in writing because this contract involving the providing of services (repairs, replacements, maintenances, and others) exceeding a big amount of money. To avoid misunderstandings and disagreements and to reduce the possibility of perjury by one party or the other, this contract should be in writing. Furthermore, because it can be performed in less than one year, this kind of contract can be in oral form, and it requires involving the third party (a witness) who in case of the trial will bring a reasonable and effective evidences, otherwise one of the party might deny that the contract ever existed or might disagree on the terms of the contract. Besides that this contract is a service contract, it is also a good contract because it requires implementation of goods components in modernizat ion of the software. (Article 2 of the UCC) This contract, like all contracts become enforceable if all the elements of the contract have been fulfilled without fail. First that prove that the contract is enforceable is the offer. * The offer is a proposal made by one person to another person for the sale and purchase of goods, to engage in a job, action participation, and provision of services. So this contract offers software system design and programming services, in the future is valued at $ 52,800.00 for the state of Oregon. * Another element mentioned in the contract is acceptance. In general acceptance of an offer is a manifestation of assent to the terms thereof made by the offeree in a manner invited or required by the offer. Acceptance in this case is described that contractor, herein Pro DX, agrees to perform the work in accordance with the terms and conditions of this contract. * Another important element found in this agreement is the legal consideration; this means that each party must provide something of value. In our contract this means that one party (Pro DX) will provide a service (such as maintenance, programming services, software), or a product, in exchange for money (from the State of Oregon, therein represented by the DHS). * If talking about a Professional Data Exchange Company and State of Oregon, we automatically can say that another element of contract is automatically respected. This is capacity to create a contract such means that each party must have the legal capacity to enter a contract. In most jurisdictions that means that they must be at least a certain age and of sound mind. For this mentioned companies it may mean that the individual is given express authority to enter a contract in the company’s bylaws or other formal documents, such is State of Oregon that is acting by and trough its Department of Human Services, Office of Information Services, hereinafter referred to as DHS. * An element with the biggest importance is that this contract has a legal purpose. And it is, because this agreement refers just to providing of services and not illegal things. * The last element that should make enforceable this contract is that both parties should be mentally competent. In special this contract, has all this requirements but it is still unenforceable because it doesn’t have so little elements that also make a contract enforceable. These are: the commencement date of the contract, party’s rights written in and not only the responsibilities, and party’s signatures and stamps. 2. What are the responsibilities of both parties? The important responsibilities of the contractor (therein as Pro DX) are: * To provide system design and programming services, including COBOL II, Easytrieve Plus, CICS, CA Intertest and VSAM and DB2 file structures, and make corrections approved by DHS Project Manager. * To construct or modify and implement programs/ files that will control the processing of rates on the JD/CBC system, based on DHS supplied Project Design document and criteria. * To perform design changes, programming, acceptance testing or implementation to address unforeseen error(s), newly discovered bugs and/or interfacing issues. * To demonstrate successful implementation of the production system content with the requirements of Statement of Work to DHS Project Manager. * All these services should be provided in specific limit of time and cost. While the DHS Project Manager responsibilities are: * To provide the necessary methodologies and standards that conforms to documentation standards. * To promote the rules for completing each task within time frame and approval of every task. * To define and document what testing data is needed for the CBC/512 rate structure project. * To pay for services provided by contractor herein as Professional Data Exchange (ProDX). 3. What are the possible damages and liabilities? If Pro DX breaches the contract, the possible damages can be: * The DHS might sue the party for a remedies under the law; * The Pro DX will be enforced to pay the caused damages, that can be compensatory, liquidated, nominal, and/or punitive damages. * The Pro DX can be enforced to a specific performance. Basically a decree requiring the breaching party to perform their part of the bargain in the contract. * Pro DX might meet with the terms such -Cancellation and Restitution. A non-breaching party may cancel the contract and sue for restitution if the non-breaching party has given a benefit to the breaching party. The former contract which is the subject of dispute is â€Å"rescinded† (cancelled), and a new one may be formed to meet the parties’ needs. * Pro DX will have to pay the attorney’s fees and cost. (in case of litigation). If we will look from the DHS’s side, the possible damages that can appear are: * To waste time waiting for the performance; * To lose the work that should be provided after the implementation; * Damage also includes the costs of hiring another company to finish the job. The liabilities that can be provided by Pro DX are: * To provide the programs and software that will satisfy the State of Oregon; * To complete all maintenance work within time frame; * To not to exceed the cost and work hours. The liabilities that should be provided by DHS are: * To establish the criteria and methodologies necessaries to accept the new right implemented programs and software; * To make corrections (if needed) in the supplied services; * To pay money for successful implemented system. 4. What impact does a potential breach of contract have on the business? So in the case of non-fulfillment of a contract by one party (for example by Pro DX), as a result the other party (DHS) suffers losses. Breach of a contract has negative effects, and has wide ranging consequences both legal and practical to the parties to the contract: * Loss of money – (if, for example, Pro DX refuses to form his side of the bargain on the due date or performs incompletely, in result the second party, DHS, will lose their money for this implementation and also will lose their time spend on waiting for, and somehow will lose the profit that can be made further). * Loss of time (if, for example, Pro DX’s programs and software will not be accepted by the DHS’s side, the first will result that lost their time, and some files or programs, for doing this job). * Loss of a financial partner- it can be lose a potential investor or/and the business with who you are dealing. * Loss of trust- it is bad for any business, because no one will have pleasure to make business with an entity that lost trust in the market. * Loss of markets- insufficiently active or successful business means a loss of competitiveness and loss of market. * Injury to reputation It is not good for a business reputation if word gets out that they have not honored their part of the contract. Other companies will be reluctant to do business with an entity which has previously defaulted on other contracts. 5. Summarize, by reflecting in general on the impact legal issues can have in both small and large businesses. Although some recent studies have looked at the impact of regulations on the relationship between government and private business in general, the attention has been directed toward understanding precisely how government regulations have affected small businesses. There is good reason to believe that size matters. Precisely because of their smaller size, small businesses are likely to be less diversified and less able to leverage economies of scale or to access capital markets. As a result, small businesses might be more risk-averse and less able to react to unexpected events compared to larger businesses. Large firms with deep pockets might be more frequent targets of employee discrimination, wrongful discharge and other suits. Large firms might also have a stronger incentive to spend substantial resources aggressively defending any one suit so as to deter future suits. On the other hand, small firms may be more vulnerable to breach of a non-compete agreement or violation of trade secrets rules as the entire business may depend on that trade secret. As a result, they may be more likely to prosecute, in spite of the costs and the risks of bankruptcy. (http://www.census.gov/epcd/www/smallbus.html, Source: U.S. Census Bureau.) Also as an owner of a small business or a large business, the common danger of crippling litigation should also be at the top of your priorities. Disgruntled Employees, Discrimination/Harassment Cases, Immigration Audits – any business should make sure that all its company’s employees can legally work in the United States. Unsatisfied Customers Customers who are unsatisfied can file class action lawsuits against the company, in which they gather in large consumer groups and attack the company over faulty products, services or promises. With enough unsatisfied customers, class action lawsuits can do more damage than any individual or corporation and irreparably tarnish your brand’s image. Other Legal Issues These are only some of the most common legal issues facing small and large businesses today. Good communication in the workplace and a hands-on approach to management is the best deterrent to legal issues. Of course the big companies that are facing with these issues, the damage (financial risks, or company image) are higher and have a more sever reflection, than a small company could have. 6. What are the implications this project has for your chosen career? At the end of this evaluation of the contract, as a future accountant, I understood that the contract is the safer way to make an exchange of goods and/or services. I got the knowledge what is a valid contract, what it makes enforceable, what are the elements of the contract, what are the risks and liabilities. This big source of information will help me to be more capable and to feel free while signing a contract. Those skills will help me to manage my business or my job as accountant without breaking the law. Everyone in his life has deals with the contracts, even if this is unwritten or is written one. Even in the supermarket, or when we are buying clothes, we are doing the exchange of money and a product. So the rules of the contract is that one party is offering something, when another party is considering your offer and decides to have a relationship with you or not. Also, as an accountant or a business woman, an important thing is to know how, to behave in unexpected situation. In activity of businesses can appear the situations called Force Majeure- this is an emergency, do not depend on the participation of the parties. (For example: fire, earthquakes, hurricanes, and others.). In this case, none of the parties is legally responsible for its obligations. Further, to that contract, is made an additional agreement, which specifies other conditions. So knowing what is legal and what are the criteria that make a contract valid and enforceable will help me to succeed in my accountant ca reer. Conclusion Business law courses were often overlooked in high school, or college. It’s not an education required strictly for attorneys that represent and defend businesses, in fact it’s pretty much for almost anyone. Contracts are written or oral agreement between two or more parties. The parties can be individuals, companies, non-profits or government agencies. With a contract, two or more parties agree to exchange services or promises. Many parts of our daily lives involve contracts. When we buy an insurance policy for the home or the car, for example, we are entering into an agreement. Many people have employment contracts. Even when we go to a doctor these days we have to sign a contract agreeing to receive medical treatment. If speaking in special about this analysis of a contract, about knowing how and when we enter into a contract to be safer, more convenient and profitable. So business law through information and specific examples will help us to get more information sought. In analysis of such a contract, we are able to focus on the elements and requirements so, that we do not overlook anything. This practice will develop in the future to have a professional behavior in the process of concluding a contract.

Women, Sport and Film :: Movies Films Athletics Essays

Women, Sport and Film The history of women’s sports is a rocky one with some many obstacles against the establishment of a competitive league for women. It is somewhat unusual to think of a time period where women were not allowed to play sports or have any say in which sports they were to play. However, one must only look back about a century to find a period in history where men believed that women were physically and socially unable to play sports. Men believed that a woman would damage her reproductive organs by playing any type of sport and would damage her image of being a lady if she was found to be physically exerting herself. Thankfully, these thoughts did not persist and the establishment of all women athletic associations was seen. Yet, once again men tried to intervene and eventually were able to cause a merger of the two genders under one heading, primarily the NCAA. This merger eliminated many of the leadership roles women had previously held and therefore causing women to play under the shadow of men. The beginning of women in competitive sports can be traced back to the 1890’s and the introduction of basketball to women at Smith College. However this initial involvement was linked to medical reasoning more than anything else. Women physical educator’s mission was to â€Å"balance the rigors of intellectual life with healthful and ‘appropriate’ sporting activities.† In order to maintain the appropriateness of sports, there were only female physical educators and only specific sports where practiced. These sports included swimming, tennis, golf, dance, and basketball. During the 1890’s the Committee of Women’s Athletics was begun and was responsible for setting regulations that educators needed to follow when in came to sports and women. This was the first example of women in a leadership role within the sports sphere. The CWA believed that women should not be included within the Amateur Athletic Union (AAU) due to the practices they had witnessed by the AAU in terms of men’s sports. The CWA was able to claim â€Å"legitimate jurisdiction over all females in educational sports and tried to control athletics in the public sector as well.† This control was something that women tried to hold on to during the beginning of the following century, however this grasp would be harder and harder to maintain. As the twentieth century continued women sports were in a constant battle with the AAU and other organizations pertaining to the merger of the two spheres.

Role Adversity Plays in Shaping Identity

Role adversity plays in shaping an individual’s identity Discuss the idea(s) developed by the text creator in your chosen text about the role adversity plays in shaping an individual’s identity. A man is insensible to appreciate prosperity until he has tasted adversity. Adverse situations shape an individual’s identity and play a significant role in one’s life by shaping personal values, determining one’s own potential and self worth. Khaled Hosseini conveys how hardships shape individuals identities through the characters of Amir, Baba, Hassan and Ali in his novel The Kite Runner. Like every individual they go through a series of incidents and hardships that shape who they become and how well they deal with struggles in life. Life is not about finding one’s own self, but about creating and learning from experiences. As one goes from childhood to adulthood and deals with the hardships of life, they grow as a person and learn from their experiences. Amir’s journey of life displays how incidents and hardships shape ones identity. Amir as the kite fighter lets Hassan the kite runner get raped by Assef due to fear, jealousy and need for love. He sacrifices Hassan for his selfish desires and the need to prove himself worthy to Baba. â€Å"I actually aspired to cowardice, because the alternative, the real reason I was running, was that Assef was right: Nothing was free in this world. Maybe Hassan was the price I had to pay, the lamb I had to slay, to win Baba. † Hassan’s rape shaped Amir’s identity and his personal values. He valued Hassan but he valued Baba’s love even more. He valued his need for acceptance more than humanity and loyalty to his friend. Rape created guilt and regrets; it shaped Amir’s personal values. After betrayal the need to belong was a struggle for Amir. He looked for ways to make Baba proud of him and searched for acceptance. It’s only natural to want to be accepted and loved however one has to decide how far they are willing to go to achieve that. Amir’s actions and decisions resulted in his loss of innocence which shaped his identity and character. Adverse situations in Amir’s life made him realize his own potential and had an effect on self worth. When Amir is at last given a way to be good again he redeems himself by becoming the kite runner. Amir goes into Afghanistan under the Taliban regime, as an adult, to rescue Sohrab. By rescuing Amir relives himself of overwhelming guilt that compounded over years. Getting beaten up by the rapist and bringing Sohrab back home makes him feel worthy. He no longer feels useless however he achieves true redemption when he becomes the kite runner instead of the kite fighter for Sohrab. By saying â€Å"For you, a thousand times over,† he amends for Baba and his sins and forgives himself. Hardships made Amir who he was since the beginning and he grew as a person by the end. Amir learned from experience and determined how adversity played a role in shaping his values, determining his potential and providing him with a feeling of self worth. Every individual learns from experience and grows as a person all together. Baba as Amir’s father also faced adversity and it shaped his identity as a person. Incidents from his past created his future and played a significant role in creating his character. Baba slept with Ali’s wife behind his back and Hassan was the living proof of his betrayal and disloyalty towards his friend. Sanaubar carrying Baba’s son created an adverse situation which teaches everyone a lesson about honor and disloyalty. All his life he had to hide the truth from the world and by keeping Ali and Hassan safe in his house he was revising for his mistakes. â€Å"I don’t care about the money or the watch. † He forgives Hassan for stealing despite the fact that he considered theft as the only crime. He was always nice to Ali because he was guilty and wanted redemption. His past affected his decisions and shaped his identity. It strengthened his personal values and made him question his self worth. Baba’s experiences with women in his life made him stronger since he stood up for a strange women’s honor on their way to Pakistan. When the Russian soldier asked for half an hour with the lady in the back Baba stood up and spoke against it. Baba had the courage due to his past experiences and adverse situations he has already faced. I will take a thousand of his bullets before I let this indecency take place. † His personal values and beliefs went against Russian soldiers demands only because incidents before have had an impact on his character and they shaped his identity. Baba constantly tries to do good deeds to redeem and perhaps forgive himself. Another example of shaping identity is society pressure. Baba’s image mattered, how other people saw him and how they treated him was a part of his personal values and self worth. Wealth, status and honor were how he was portrayed in front of society. Society pressure and judgment shaped Baba’s identity and impacted his decisions. He was ashamed to tell everyone that he is Hassan’s father, a father to a Hazzara. He did not want to lose his identity of being a Pashtun or be disrespected due to his past. Just as Amir Baba was willing to deal with guilt and regret for personal desires and searched for true redemption the rest of his life. Different people have various beliefs and their own way of doing things. Hassan was one exceptional character whose loyalty overruled all betrayals in the novel. Just as any other individuals Hassan dealt with hardships in life however Hassan’s selflessness made him far different from Amir and Baba. Hassan was illiterate and wanted to learn how to read and write. He used Amir for his personal desires, the desire to read and learn. â€Å"we sat for hours under that tree, sat there until the sun faded in the west, and still Hassan insisted we had enough daylight for one more story, one more chapter. † At that time in Afghanistan written words were no use for servants especially if they were labeled a Hazzara. Hassan being Ali’s son, who was only true for the world, had to live with being illiterate and deprived from his rights to knowledge. Difficult events and hardships shaped Hassan’s identity and life. His illiteracy was a part of him and had an impact on the decisions Hassan made in life. Hassan was naive and his innocence poured out through his actions of friendship and true loyalty. The character of Ali also conveys how situations of life shape ones identity, how they create a person and determine ones potential. Ali was Baba’s servant and that was a reason for why he was never able to speak up for justice. When Hassan was framed for stealing from Amir, Ali had the choice to tell the truth, he restrained from giving up Amir only because he gave Hassan his word. Baba and Amir were always superior and Ali’s personal values told him that it was better to leave it as it was. Ali realized his self potential then and left home with his honor and dignity. Adversity was essential for developing his self worth and Ali’s role as the servant shaped his identity and plays a significant role in his values and beliefs. Similar to Ali Hassan strengthened his beliefs through hardships and truggles, Hassan was loyal at the beginning and despite of all the betrayal and deception from Amir he stood loyal and strong until the end when he sacrificed himself once again while guarding Baba’s house. When faced with adversity, there are a select few who can push it aside for the greater good. It takes a special kind of person to do what Hassan did. He followed through his principles which s haped his character and identity. People don’t appreciate happiness and everything they have until life takes a turn and teaches a valuable lesson. Amir, Hassan, Baba and Ali’s identities and characters were shaped around adverse situations and hardships of life. Difficult situations they faced created who they were; it strengthened their personal values, determined their potential and provided the feeling of self worth. Adversity teaches one’s self that a path with no obstacles, probably doesn’t lead anywhere. It is essential for growth of an individual throughout life because sometimes in tragedy one finds his life purpose- the eye sheds a tear to find its focus.
